These Terms govern your access to and use of the eRunna mobile applications, websites, and services (the "Services"). By using the Services, you agree to these Terms.
1. Who we are
"eRunna", "we", "us" or "our" refers to eRunna (Pty) Ltd (provisional). Parent/shareholder: BIX Technology (provisional). Contact: support@erunna.app.
2. Eligibility and accounts
- You must be at least 18 to use the Services.
- You are responsible for your account credentials and keeping them secure.
- Provide accurate information and keep it up to date.
3. Platform nature; independent contractors
- eRunna is a marketplace that connects customers with independent runners (couriers) and merchants. We do not provide delivery services and are not the employer of runners.
- Runners act as independent contractors.
4. Using the Services
- Do not misuse the Services (no fraud, abuse, reverse engineering, scraping, or interfering with operations).
- Follow applicable laws and community safety expectations.
- We may suspend or terminate accounts that violate these Terms.
5. Pricing, payments, and refunds
- Prices and fees are shown at checkout. Taxes may apply.
- Payments are processed via third-party providers (e.g., Paystack). We do not store full card numbers.
- Refund eligibility is evaluated case-by-case per our policies and applicable law.
6. Orders, errands, and delivery
- Estimated times are not guarantees. Availability depends on runner/merchant acceptance.
- You are responsible for providing accurate pickup/drop-off details and being available to receive deliveries.
7. User content and feedback
- You grant eRunna a non-exclusive, worldwide, royalty-free license to use feedback you provide to improve the Services.
- Do not upload unlawful, infringing, or harmful content.
8. Location and device permissions
The app uses foreground and background location to provide matching, live tracking, safety features, and route/ETA updates. See the Background Location Disclosure and Privacy Policy for details.
9. Prohibited conduct
- No harassment, discrimination, or unsafe conduct.
- No attempts to circumvent payments or platform policies.
- No unauthorized access or scanning.
10. Service changes
We may change or discontinue features. Where material, we will provide notice where feasible.
11. Warranties and disclaimers
Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the extent permitted by law, eRunna will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our aggregate liability will not exceed the greater of: (a) the amounts paid by you to eRunna for the order giving rise to the claim, or (b) ZAR 1,000.
13. Indemnity
You agree to indemnify and hold eRunna harmless from claims arising from your misuse of the Services or violation of these Terms.
14. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if required by law.
15. Governing law and disputes
These Terms are governed by the laws of South Africa. Courts of South Africa have exclusive jurisdiction, unless mandatory consumer law provides otherwise.
16. Changes to these Terms
We may update these Terms. We will post the updated version with a new "Last updated" date and, where material, provide in-app notice.
